JUNK MOTOR VEHICLES

303.09 REGULATING STORAGE OF JUNK MOTOR VEHICLES ON PUBLIC OR PRIVATE PROPERTY.


(a) No person shall store, park, or leave, or permit the storing, parking or leaving of any junk motor vehicle, or parts thereof, on any public or private property in the Village of Holland for more than seventy-two (72) hours, unless said junk motor vehicle is kept in a frilly enclosed and properly zoned building, out of public view.

(b) This provision shall not apply to scrap metal processing facilities licensed under the authority of Section 4737.05 and 4737.12 of the Revised Code; the operation of a motor vehicle salvage dealer, salvage motor vehicle auction or salvage motor vehicle pool by a person licensed under Chapter 4738 of the Revised Code; or the provision of towing and recovery services conducted under Section 4513.60 to 4513.63 of the Revised Code, including the storage and disposal of junk motor 9 vehicles removed from public or private property in accordance with those sections.

(c) A junk motor vehicle means any motor vehicle, as defined in Ohio Revised Code Section 4511.01 that is apparently inoperable, and/or not capable of starting or traveling under its own power, including a vehicle with a flat tire or tires, or any such vehicle not bearing current registration, or if bearing such current registration but is extensively damaged, including but not limited to any of the following: missing wheels, tires, engine, doors, or any other essential parts, or a vehicle which remains stationary or unused for more than thirty (30) consecutive days, or any motorized bicycles, mini-bikes, all terrain vehicles, road rollers, traction engines, power shovels, power cranes, and any other equipment used in construction work, which is not capable of starting or traveling under its own power, or missing essential parts, or remains stationary or unused for more than (30) consecutive days.

(d) In addition to other remedies provided by law, the Village of Holland may institute an action for injunction, mandamus or abatement or any other appropriate action or proceeding to prohibit the storage of junk motor vehicles in violation of this section.

(e) Notification of violation shall be made by certified mail, personal service, or by leaving the notice in a conspicuous location on the premises to the person either having ownership of the property, tenant of property, and/or the person of record owning such junk motor vehicle. Notification shall direct the person either having ownership of the property, tenant of property, and/or the person of record owning such junk motor vehicle to have such vehicle inspected by the Holland Police Department at the Municipal Building within five (5) days of service of such notification. Failure to have such vehicle inspected is prima-facie evidence of willful failure to comply with the notice.

(f) Junk motor vehicles stored on public property or private property used for the purpose of vehicular travel without the permission of property owner may be towed immediately with the approval of the Chief of Police, Owner assumes all costs and expenses associated with towing.

(g) Whoever violates this Ordinance is guilty of a minor misdemeanor. Bach day that a violation of this section continues constitutes a separate offense. Fines levied and collected under this Section shall be paid into the Village general revenue fund.
